Agreement between Socal Bite Club LLC and Pet Owner(s)
- By booking any of our services online or in person, pet owner agrees that they have read and accept all terms on this page and agree to these terms.
1. Private Lessons
A 24-hour cancellation/rescheduling notification is required. If pet owner(s) fails to show up, is late to the scheduled lesson, or does not give the required 24 hour notice, they will still be responsible for the entire payment of lesson.
Lessons will be held at specified location. An added fee will be charged for travel to client's desired location.
2. Boarding/Board & Training Services:
A deposit of half down is required to secure Boarding/Board & Train dates for your pet. A one week (7 days) cancellation/rescheduling notification is required and FULL payment is due one week before start of training period. Cancellations/rescheduling occuring within one week of expected start date of Boarding/Board & Train will result in loss of pet owner(s) deposit. The cost of Boarding/Board & Train includes day of drop-off and pick-up regardless of time dropped off/picked up. Pet owner is responsible for the full payment of boarding/board and train even if they chose to pick up their pet earlier than scheduled date. Payment methods accepted: Venmo, Zelle, Cash, Check, & Credit Card.
Pet owner gives permission for lessons to be conducted on property as welll as off property.
The skills worked on in the Board & Train will be determined by the package selected. SoCal Bite Club LLC will provide progress reports throughout the week to the pet owner. The pet owner will receive training on the transfer/go-home day to maintain training goals.
If dog has not met desired goals, SoCal Bite Club LLC will review whether these goals can be met with additional training (additional cost required) or with a follow up training session.
Maintenance:
The pet owner agrees to understand and apply the basic principles of training as described in the transfer/go-home lesson and to use the commands provided by SoCal Bite Club LLC.
No refunds are available on Board & Train packages. SoCal Bite Club LLC will be available for phone calls and emails for a 2 month period after the Board & Train transfer/go-home lesson. (4 instances max).
Client agrees to reimburse SoCal Bite Club LLC for reasonable expenses during Boarding/ Board & Train arising from/relating to:
· Additional Food Requirements
· Medical care and treatment
· Emergency medical care
3. Emergencies.
If there is an emergency, SoCal Bite club LLC will make all reasonable efforts to first contact the pet owner. If the pet owner is unable to be contacted, SoCal Bite Club LLC shall contact the emergency contact. In addition, pet owner authorizes SoCal Bite Club LLC to seek and obtain medical attention and treatment as deemed necessary by a veterinarian.
4. Injury and Indemnification.
If the pet(s) accidentally dies, becomes ill, injured, or lost, the pet owner waives and releases SoCal Bite Club LLC from any claim arising from such an incident. If the pet(s) bites or injures training staff, any other human or animal, the pet owner will be responsible for any resulting injury. In addition, the pet owner shall hold harmless and indemnify SoCal Bite Club LLC against any and all costs, expenses, losses, liabilities and claims arising out of or relating to any acts of the pet(s) except if arising out of the negligence or intentional misconduct on the part of SoCal Bite Club LLC.
5. Liability.
The pet owner assumes the risk and agrees that SoCal Bite Club LLC or any of it's trainers, should not be held responsible for any resulting injuries, losses, damages, costs, or expenses. SoCal Bite Club LLC is not responsible for any injuries or expenses resulting from the socialization or training of your dog. The pet owner further understands and acknowledges that dogs may be injured by running, jumping, chasing a ball, etc. SoCal Bite Club LLC reserves the right to terminate training if the pet owner's dog is deemed dangerous.
ASSUMPTION OF RISK & RELEASE OF LIABILITY
ASSUMPTION OF RISK
The undersigned (“you” or “Participant”) acknowledges that he/she is voluntarily participating in dog training provided by SoCal Bite Club LLC with knowledge of the potential dangers.
Participant represents that he/she is the owner or guardian of the dog(s) identified in this Agreement.
You acknowledge that dogs are unpredictable animals with their own will and drives, and therefore, regardless of training, handling, or environmental circumstance, SoCal Bite Club LLC cannot protect against every potential injury, risk or accident to you, to other persons participating in the training or on the property where the training is taking place, or to dogs.These may include dog attacks, dog bites and the responsive actions and complications that arise from them, and you understand and acknowledge that such risks are inherent and cannot be eliminated.
This Agreement is intended to shift the risk of participating in dog training to you. Do not sign it unless you are willing to assume the risk to yourself, your dog, and others accompanying you of your participation in dog training, including the associated risks of bodily injury, death or property damage while participating in the dog training and related activities on the property of SoCal Bite Club LLC, in your own home, or in a public space.
RELEASE OF LIABILITY
Participant agrees that in consideration for being permitted to participate in dog training provided by SoCal Bite Club LLC, and/or to use any of SoCal Bite Club LLC facilities in connection with dog training, Participant, for himself/herself, and his/her heirs, next of kin, executors, and personal representatives (collectively, “Releasors”), assumes the entire risk associated with participating such an activity and waives, releases, discharges and covenants not to sue SoCal Bite Club LLC, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers or other representatives, their successors and/or assigns (collectively, “Releasees”), from any and all liability to Releasors for any loss, harm, damage, claim, injury (including death) or accident to the person or property of Participant, Participant’s dog, and any other persons accompanying Participant at the dog training, including any minor children, arising out of or related to participating in dog training or using any facilities or equipment of SoCal Bite Club LLC, even if caused by any negligent act or omission of Releasees.
Nothing herein is intended to release Releasees from any harm, injury, claim or damage caused by intentional, wanton or reckless misconduct.
INDEMNIFICATION
You agree that you are and will be responsible for your conduct and the conduct of your dog and others accompanying you (including minor children) at all times. You agree to indemnify and hold harmless SoCal Bite Club LLC, its directors, officers, members, managers, employees, agents, sponsors, organizers, volunteers and other representatives (“SoCal Bite Club LLC Personnel”), from any and all claims of injury (including death), loss, cost, expenses, or damage to persons, dogs, or property caused by the acts or omissions of you, your dog, and any other persons accompanying you, including any minor children, during the course of training or related activities, as well as by the conduct of your dog under your own care as a result of following training instructions. This provision applies whether the claims are made by you, family members, your accompanying guests, SoCal Bite Club LLC Personnel, or third parties.
NO GUARANTEE OF RESULTS
You recognize that the role you play in your dog’s learning process is integral to achieving desired results. You acknowledge and agree that there is no guarantee that your dog will achieve the desired level of training despite the best efforts of SoCal Bite Club LLC. You further understand that the recommendation of any other product or service by SoCal Bite Club LLC is not a guarantee of satisfaction with that product or service.
ALL PAYMENTS ARE NON-REFUNDABLE *
We do not offer a monetary refund. Instead, we stand 100% behind our training.
Our dog training programs form a partnership between our clients, their dog, and the trainer. The success of our program depends on us performing our job correctly, and also on the owner following up on the homework and strategies that we lay out for them.
You expressly agree that the foregoing assumption of risk, release, waiver, and indemnity provisions are intended to be as broad and inclusive as permitted by applicable law, and that if any portion thereof is held invalid, you agree that the remaining provisions will continue in full force and effect.
GOVERNING LAW
The terms of this Agreement shall be governed by and construed in accordance with the laws of the State of California not including its conflicts of law provisions.
